Stamrecht bij buitenlandse verzekeraar mogelijk

De staatssecretaris van Financin heeft in een besluit de mogelijkheid geopend voor buitenlandse lichamen om zich aan te laten wijzen als verzekeraar van een stamrecht als bedoeld in artikel 11, eerste lid, onderdeel g, van de Wet op de loonbelasting 1964. Dit besluit loopt daarmee vooruit op een wetswijziging.

jammer dat er niets gezegd wordt over de mogelijkheid om in deze situatie artikel 32aa niet toe te passen op RVU-stamrechten; in artikel 6 is de inhoudingsplicht hiervoor niet geregeld. Voor mij is dit een aanleiding om voor te stellen verzekeraars geheel uit artikel 32aa te weren. De heffing over het rendement is er ook niet in BOX III (technisch wel verdedigbaar/juist, maar de ongelijke behandeling wringt). De oplossing van de fiscus om deze heffing in rekening te brengen bij de verzekerde (negatief rendement of op de netto uitkering, lijkt niet meer mogelijk. (Sovak HR C06/220).
